Texas executes more people than all the other states in the union combined. Its death row is overflowing. With that in mind, I can't imagine Donald Andrew Bess escaping the needle. This guy is a nasty piece of work. I still don't believe in capital punishment, but giving this guy what he really deserves - solitary confinement for the rest of his natural life - would probably constitute, in some people's minds, "cruel and unusual punishment."
By the way, do you know why the courts rationalize that the state killing someone is not "cruel and unusual"? It's because of that conjunction "and." While some may argue that executing a human being is "cruel," because Texas does it so often, it can't be called "unusual." and, according to the courts, it must be both before it can be constitutionally banned.
